If you are injured by taking a generic prescription drug, or even die from it, you and your estate are barred from suing the manufacturer of the drug because of a recent Supreme Court rulings, Pliva v. Mensing, and Mutual Pharmaceutical Co. v. Bartlett. The Pliva case involved a failure of the drug manufacturer to warn about harmful side effects.
