after he was denied admission to Booth’s Theatre. That case was dismissed because Davis's witnesses failed to appear.

 

On December 9th, Singleton was indicted. It was the first criminal proceeding in New York State under the Civil Rights Law. The case was heard on January 14, 1880. The attorney for Singleton, Louis Post, argued that    the Civil Rights Act was unconstitutional, because it  interfered with the rights of citizens and their private    property. The judge referred the issue to the Circuit Court, which could not reach a decision, and referred the case to the Supreme Court.
